A Lil Durk bond hearing is set for November 4 at 2:30 p.m. after defense counsel requested a review of his detention, AllHipHop reported Friday, September 18. According to the report, U.S. District Judge Michael W. Fitzgerald also directed Probation and Pretrial Services to attend and provide an updated bail report, while the new order did not list a new date for Durk’s second trial.
The update came after an earlier status check suggested October 5 was still the operative setting. Journalist Michael Blackshire said on September 17 that he had not seen a motion concerning the next trial, and the court’s September 11 minute order had set October 5 for trial on the remaining counts of the fourth superseding indictment. The November bond setting is now the newest reported court development in the case, although the publicly described September 18 order does not itself spell out a new trial date.
Lil Durk, whose legal name is Durk Banks, remains in federal custody after a Los Angeles jury acquitted him on all five counts tried against him on September 11. The verdict cleared Banks of Counts 2 through 6, but it did not resolve the charges Judge Fitzgerald had severed for a separate proceeding, which is why the acquittal did not automatically end his detention.
The remaining case includes Count One, murder in aid of racketeering, and Count Seven, a firearms charge tied to that alleged offense. In the fourth superseding indictment, prosecutors allege both counts arise from the August 19, 2022 Los Angeles shooting that targeted Quando Rondo and killed his cousin Saviay’a Robinson, while the indictment also sets out broader allegations about what prosecutors call the “Banks Gang Enterprise.” Banks has pleaded not guilty, and those allegations have not been proven at trial.
The November hearing gives Banks another opportunity to argue for pretrial release after previous requests were denied. The new scheduling order, as described in the September 18 report, requires an updated bail assessment, but it does not indicate how Judge Fitzgerald will rule or whether any conditions could satisfy the court’s concerns, so the hearing should not be read as a grant of bond.
The timeline changed quickly on September 18: the earlier picture was that no motion had been reported to move the October 5 setting, then the court placed a bond review on the calendar for November 4. As of Friday evening, the most precise public status is that a bond hearing is now scheduled and the later order does not identify a new trial date; a further court entry would be needed to verify whether October 5 remains operative.
